Careful Considerations

Filing for a federal trademark registration? Here is what you need to consider:
  • Is what you are trying to protect even a trademark? Is it being used as a trademark?
  • Is your great idea someone else’s great idea, only they thought of it 5 years ago, when they filed their application? You need to know if anyone else has beaten you to the punch.
  • What are your services? What are your goods? Is this good or service unique and new?
  • Have you begun selling products or services under the mark yet? This will determine what type of application needs to be filed with the United States Patent and Trademark Office.
  • Our new application services are designed, through careful research and consultation, to get you through this process with the greatest chance of seeing your mark registered.
Have you already filed a federal application but have run into trouble? Here is what you need to consider:
  • Have you had a chance to read through the office action? Do this as soon as you can.
  • Have you tried to contact the examiner? They usually have their contact information listed near the end of the office action. Try to get an idea of what is going on from the very person who thinks there is a problem. You can often straighten simple issues out right over the phone with the examiner.
Do you need to take steps to keep your registrations current? Here is what you need to consider:
  • How long has it been since you filed your application?
  • How long since the mark has been registered?
  • Have you considered international Trademark registration?
  • Has anyone disputed your claim to ownership of the registration?
Do you need to protect your mark against infringement? Here is what you need to consider:
  • Do they have a registered Trademark?
  • How long has the infringer been using the mark?
  • Are people using your Trademark in search engine advertising?
